These Terms of Use (“Terms”) govern your access to and use of Tartan Trail, including the Tartan Trail mobile app, website, event directory, voting features, submission forms, organizer claim tools, admin tools, and related services collectively referred to as the “Service.”
Tartan Trail is operated by The Scottish Cultural Outreach Foundation INC (“Tartan Trail,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About Tartan Trail
Tartan Trail is a directory and discovery platform for Scottish Highland Games, Scottish festivals, Burns Suppers, Tartan Day events, clan gatherings, concerts, cultural programs, competitions, workshops, and related events across the United States.
The Service may include event listings, search tools, maps, saved events, user voting, event submissions, organizer claim features, featured listings, and community updates.
2. Eligibility
You must be at least 13 years old to use Tartan Trail.
If you use the Service on behalf of an organization, event, society, clan, festival, venue, or other entity, you represent that you have authority to act on behalf of that entity.
3. Accounts
Some features require an account, including saving events, voting, submitting event updates, claiming an event, or using organizer tools.
You agree to:
- Provide accurate account information
- Keep your login credentials secure
- Not impersonate another person or organization
- Not create duplicate or fake accounts
- Notify us if you believe your account has been compromised
We may suspend or terminate accounts that violate these Terms or appear fraudulent, abusive, or harmful.
4. Event Information
Tartan Trail collects event information from public sources, event organizers, community submissions, directories, official websites, and admin research.
We work to keep event information accurate, but we cannot guarantee that all event details are complete, current, or error-free.
Before attending an event, purchasing tickets, booking travel, reserving lodging, registering for competitions, vending, performing, or making plans, you should verify details directly with the official event organizer or official event website.
5. Event Submissions and Suggested Updates
Users may submit new events or suggest corrections to existing listings.
By submitting event information, you represent that:
- The information is accurate to the best of your knowledge
- You have the right to submit it
- It does not infringe the rights of others
- It is not false, misleading, defamatory, spammy, or unlawful
We may review, edit, approve, reject, merge, remove, or decline to publish submitted information at our discretion.
Submitting information does not guarantee publication.
6. Organizer Claims
Event organizers may request to claim an event listing.
We may ask for proof of your relationship to the event, such as:
- Official organization email
- Official website verification
- Social media verification
- Documentation
- Role/title
- Other reasonable evidence
We may approve, reject, suspend, or revoke organizer access at our discretion.
Claiming an event does not give you ownership of the Tartan Trail listing, brand, platform, or database. It allows approved organizers to help maintain accurate event information.
7. Organizer Edits
Approved organizers may submit edits to their event listings.
Some edits may require admin review before publication, including changes to:
- Event name
- Date
- Venue
- Location
- Ticket links
- Official website
- Cancellation status
- Ownership or organizer relationship
- Featured listing details
We reserve the right to reject or modify edits that appear inaccurate, misleading, promotional beyond reasonable limits, unsafe, unlawful, or inconsistent with the purpose of the Service.
8. Tartan Trail Awards and Voting
Tartan Trail may offer community voting features, including annual awards such as the Tartan Trail Awards, Best Games, or People’s Choice categories.
Voting rules may include:
- Users must be signed in to vote
- Users may vote once per category per award season
- Users may be allowed to change votes before voting closes
- Votes may be reviewed for fraud or abuse
- Suspicious votes may be removed
- Results are not final until reviewed and published by Tartan Trail
We reserve the right to determine eligibility, voting periods, categories, finalists, winners, tie-breaking procedures, and publication of results.
Tartan Trail Awards are community recognition features and do not imply certification, endorsement, sponsorship, partnership, official ranking, safety approval, or legal verification of an event.
9. Featured Listings and Promotions
Tartan Trail may display featured events, sponsored placements, highlighted listings, or premium promotional content.
Featured placement does not guarantee attendance, ticket sales, ranking, awards, endorsement, or results.
Featured listings must still comply with these Terms and may be reviewed for accuracy and appropriateness.
10. User Content
The Service may allow users to submit content, including event details, corrections, descriptions, reviews, comments, feedback, images, documents, votes, or organizer information.
You retain ownership of content you submit, but you grant Tartan Trail a non-exclusive, worldwide, royalty-free license to use, display, reproduce, edit, publish, distribute, and create derivative works from that content for the purpose of operating, improving, promoting, and displaying the Service.
You agree not to submit content that is:
- False or misleading
- Defamatory or harassing
- Infringing or unauthorized
- Obscene or abusive
- Spam or promotional abuse
- Malware, harmful code, or automated scraping
- Discriminatory, hateful, threatening, or unlawful
- A violation of privacy or publicity rights
We may remove or modify content at our discretion.
11. Prohibited Conduct
You agree not to:
- Use the Service for unlawful purposes
- Impersonate a person, event, organization, or official representative
- Submit false event information
- Manipulate votes or create fake accounts
- Scrape, copy, or harvest large portions of the database without permission
- Attempt to bypass security features
- Interfere with the Service
- Upload malware or harmful content
- Misuse organizer claim tools
- Use the Service to mislead users about ticketing, event status, or official affiliation
12. Intellectual Property
Tartan Trail, including its name, logo, design, app interface, database structure, graphics, text, organization, and original content, is owned by or licensed to The Scottish Cultural Outreach Foundation INC.
You may not copy, reproduce, modify, distribute, sell, or exploit Tartan Trail content except as allowed by these Terms or with written permission.
Event names, logos, trademarks, and materials belonging to event organizers or third parties remain the property of their respective owners.
13. Third-Party Links and Services
Tartan Trail may link to third-party websites, ticketing platforms, maps, social media pages, event websites, vendors, venues, hotels, travel services, or other resources.
We do not control and are not responsible for third-party content, pricing, availability, privacy practices, ticketing, refunds, cancellations, security, or accuracy.
Your use of third-party services is governed by their own terms and policies.
14. App Store Terms
If you download Tartan Trail through the Apple App Store, Google Play, or another app store, your use may also be subject to that platform’s terms and policies.
These Terms are between you and The Scottish Cultural Outreach Foundation INC, not Apple, Google, or any app store provider.
The app store provider is not responsible for the Service, its content, support, maintenance, claims, or legal compliance, except as required by applicable law or platform terms.
15. No Guarantee of Availability
We may update, suspend, modify, restrict, or discontinue any part of the Service at any time.
We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.
16. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and security.
We do not guarantee that event information is complete, current, accurate, safe, or suitable for your plans.
17. Limitation of Liability
To the fullest extent permitted by law, The Scottish Cultural Outreach Foundation INC and its officers, directors, employees, contractors, volunteers, partners, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.
This includes damages related to event cancellations, inaccurate listings, travel costs, ticket purchases, third-party websites, weather, safety conditions, lost data, account access, voting outcomes, or reliance on event information.
18. Indemnification
You agree to defend, indemnify, and hold harmless The Scottish Cultural Outreach Foundation INC and its officers, directors, employees, contractors, volunteers, partners, service providers, and affiliates from claims, damages, liabilities, losses, costs, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your submitted content
- Your event submission or organizer claim
- Your violation of another person’s rights
- Your unlawful or improper conduct
19. Termination
We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, misused the Service, created risk for users, submitted false information, attempted vote manipulation, or engaged in harmful conduct.
You may stop using the Service at any time.
20. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules.
Any disputes will be handled in the courts located in Onslow County, North Carolina, unless applicable law requires otherwise.
21. Changes to These Terms
We may update these Terms from time to time.
When we do, we will update the “Last Updated” date above. If changes are significant, we may provide additional notice through the app, website, or email.
Your continued use of the Service after updated Terms become effective means you accept the changes.
